Join fellow senior in-house litigators navigating an evolving business and regulatory landscape in 2026. We'll dig into issues shaping today's disputes - emerging AI liabilities, expanding class action risks, governmental investigations, and cross-border enforcement - alongside the operational challenges of running a litigation function: matter management, integrating AI into workflows, cross-functional coordination, and demonstrating value through metrics.

As generative AI becomes embedded in litigation workflows, in-house teams must reassess how privilege is preserved and how discovery obligations may expand. This session focuses specifically on the exposure created by AI-assisted drafting, internal prompts, fine-tuned models, and data sharing with vendors. Panelists will examine emerging court treatment of AI-generated work products and explore practical guardrails to protect privilege while maintaining litigation efficiency.
Join Vice Chancellor Will for a fireside chat on key developments impacting in-house litigators. The conversation will cover 'Dexit' and Section 144, and will help attendees understand how they can best advise their board on incorporation discussions. Other topics to be addressed include recent amendments to Section 220, the practicalities of AI in minute-keeping, the preservation of legal privilege, and cautionary "horror stories" of AI hallucinations in court filings. Vice Chancellor Will will also share her perspective on emerging trends such as strike suits and double-derivative litigation involving subsidiary incorporation status.

We expect this program to be eligible for between 4 - 6 hours of CLE credit in 50-minute states and 4.25 hours of CLE credit in 60-minute states. Credit hours are estimated and are subject to each state’s approval and credit rounding rules. This course is appropriate for experienced attorneys only.
